Industry awaiting next steps from DOE to address CRE/WIC-F standard setting 

The clock is ticking now that President Trump has signed resolutions nullifying energy-efficiency rules for Commercial Refrigeration Equipment (H.J. 75) and Walk-in Coolers and Freezers (H.J. 24). Under the Congressional Review Act (CRA), the U.S. Department of Energy (DOE) has one year to issue new standards. At the same time, DOE’s Office of Energy Efficiency and Renewable Energy (EERE), which addresses energy efficiency standards, is facing a nearly 75% budget cut and significantly narrowed remit. NAFEM contacted DOE to understand the next steps and will keep members apprised.  

NAFEM submits Process Rule comments to DOE 

NAFEM replied to the Request for Information (RFI) from the DOE, providing comments on the energy-conservation standards rulemaking process for commercial equipment. In its feedback, NAFEM urged the agency to engage more fully with manufacturers to understand what changes are technologically feasible and to recognize overlapping regulatory measures, as well as important food safety concerns. NAFEM also advocated for transparency during the notice and comment periods and regular involvement with industry throughout the process.  

NAFEM also participated in joint comments presented by a group of like-minded trade associations, offering similar input to DOE’s Process Rule review.  

Comments due July 15 on DOE NOPR to rescind ACIM standards  

DOE also issued a notice of proposed rulemaking that rescinds the amended water use standards for automatic commercial ice makers (ACIMs). The proposal will return the standards to the statutory baseline. Additionally, the Secretary has tentatively determined that DOE lacks authority to regulate the water use of ACIMs. A public hearing was held May 29, and comments are due July 15.
