USTR Reinstates Certain Exclusions from China Section 301 Tariffs

USTR announced March 25, that some China Section 301 product exclusions will be reinstated and effective until Dec. 31, 2022.

In a press release, USTR announces its “determination to reinstate certain previously granted and extended product exclusions in the China Section 301 Investigation. The determination reinstates 352 of the 549 eligible exclusions. The reinstated product exclusions will apply as of October 12, 2021, and extend through December 31, 2022.”

U.S. Customs and Border Protection will provide further guidance on these retroactive product exclusions in the near future.

NAFEM members should review the list of imported products that will have their product exclusion reinstated to determine if they can utilize these reinstated product exclusions for Chinese imports. The list is provided in the Annex for Reinstatement section at the end of the unpublished Federal Register notice, pgs. 5-31. The formal announcement will be published shortly.
