Scrutiny increases on foreign ownership of U.S. businesses

The Committee on Foreign Investment in the United States (CFIUS) published its final rule expanding its jurisdiction following proposed regulations released several months ago pursuant to the Foreign Investment Risk Review Modernization Act of 2018. The regulations, effective Feb. 13, 2020, greatly expand CFIUS’ jurisdiction to review and approve certain U.S. investments by foreign persons and entities.
